Clarity needed on stamp duty!

Postby CuriousAboutTax » Tue May 02, 2017 12:41 pm

Hi all,

Would really appreciate your views on the below:

I own a rental property in my sole name, and there is no mortgage on it. I would like to transfer a 25% to my father for no consideration. My father already owns a couple of other homes. In this instance, I understand there would be no usual stamp duty payable, but would it trigger the 3% extra stamp duty on second homes for my dad? Just to reiterate, I would be gifting it for no consideration and it is not mortgaged.

I understand there would be capital gains tax payable by me which I would deal with of course.

Many thanks

No, as no consideration.
