Company charge me NI when below wkly threshold

Hi

Hoping someone can give me some useful advice?

I started working on -two days a week-in Feb I wasn't told that i had to claim my hours worked so had to back claim. I then proceed to claim fornightly again no one corrected me as it should have been weekly. Hence I have been paying NI as the company have been processing my claims as wkly via payroll. Also even now that I am claiming correctly the sheets are being sent late so I still on the occassion get NI charged.

I called the Tax office who explained that the company could make an adjustment as they hold NI until the end of the year. I spoke with payroll who have refused as they say the law states that you are NI'd on what is paid irrespective of when it is earned. Can someoone please clarify if this is correct?

NI is based on pay periods, be they weekly, fortnightly or monthly. If your employer runs the payroll weekly but you submit fortnightly claims, then is it possible that you are at fault here? But if fortnightly claims are expected and submitted, then the pay period should be 2 weeks.

For 2009-10 you would need to contact the NI office at Longbenton to discuss a refund. For the current year you need to argue it out with your employer.
