disclosed commission agent selling goods for export to EU from UK- VAT to principal?

Postby Trademan4 on Wed Nov 29, 2006 11:37 am

Hello all.

Im a UK based commission agent.
I'm providing sales disclosed agency work to a UK principal in the export of products to Belgium.

As its intra EU export , there is no VAT on the sale by the principal to Belgium , as I udnerstand.

QUESTION: do I have to charge my principal VAT on my selling services , as my company and his company are both in the UK?

(The Belgian buyer collected the goods in England and took them to Belgium)

Many thanks
Tim

Your supplies are standard-rated – appear to fall within para 3.6(d) of VAT Notice 744D available from the VAT helpline.

Hi
Many thanks for your reply.

I thought my supplies would be zero rated as they related to an agency deal ( sale) of product that was zero rated.- ie from an English company exporting to a Belgian company.

I know that travel agents dont charge vat when they are selling a zero rated product , so thought my case would be similar?

Are you an accountant / tax adviser?
Does anyone think differently?
Kind regards
Tim
