You must submit the Tax Return if it has been sent out to you.

Even if I was the one erroneously registering for it?

Wouldn't a letter explaining that I did not need to register suffice?

thanks for your patience.

As far as HMRC are concerned you are UK resident until they are convinced otherwise.

You can try a letter but I do not think it will satisfy them; they need all info' which they get from formal completion of the tax return etc.

Sorry to steal the thread but I am in a similar position as the OP.

My problem is that my overseas certificate of taxation does not show the period as requested by HMRC in helpsheet302.
I have asked the foreign authorities about this and they tell me that they do not provide dates on the certificate. Also the April to match date is onloy for the UK. They suggested that if HMRC insist I should tell them that they cannot expect the certificate to show dates if no such certificate exists and to contact the relevant foreign authority directly for any queries. Am I likely to get pesterd by HMRC for the exact dates or will an explanation be enough?

Thank you

Just an update.
I sent my tax return with the relevant forms 302 etc etc.

I have now received a two line letter stating that my income is zero and my tax is zero.
I stated a UK income of less than PAllw on the 302 form but whoever has processed the form has put zero income on the letter to me so I am puzzled.
I am claiming foreign residency as explained could this have had a bearing on the figure quoted in HMRC's letter?

Also the letter states that he will write to me if there are any questions on my tax return.

Is this common practice? No one appears to have signed the letter. Also am I very likely to receive other correspondence on this tax return?

An update on my situation.

I filed a tax return claiming foreign residency on the DTA basis and got a letter back saying I don't own any tax.
Now my next question is, will I have to send a SA return again next year even if my situation does not change ie. small uk assets less than allowance.
Will HMRC issue an SA request automatically?

Many thanks.
