EBT tax implication for non-resident / non-domiciled

Postby Gorlich on Thu Sep 08, 2011 6:15 pm

My UK employer used EBT for deferring part of my compensation. I no longer work for the Company, I am non-UK resident, non-domiciled from an EU country. My question is, what are the income tax implications of the fund distrubtion in my benefit.
Currently, the EBT withholds 50% Paye tax, and also NIC.

As a non-UK resident can I:
1) avoid the withholding
2) claim back the withheld taxes and in what amount.
3) do I need to pay NIC as a foreing national not resideing in the UK?
