Employers NI Refund

Hi All,

I worked under a umbrella company during 2004-05 for 3 months, after that I formed a ltd company in the same year.

During the 3 months period I was paid salary at high rate, the NI, ER NI's was deducted from my umbrella company.

While filing the self-assessment I realized that I am entitled for refund of tax due to my total earnings for 2004-05 falling in basic rate.

If that is the case, does that mean I can avail the refund from the umbrella company on the ER Ni's (employer NI's) which was paid from my earnings?.

Do I have to request the umbrella company to file for refund or is that not consideration for refund.
I will appreciate your advise on this please.

You've got no chance of getting your hands on am Employers Ni refund.....it belongs to the co ie if there was one but there will not be. From your point of view Tax rules are a mile away from Ni rules and the refund isnt going to happen in the first place for you to even think about it...
