ex partner tax investigation

Postby jivejerry on Thu Mar 25, 2010 12:45 pm

My ex partner is being investigated by hmrc. We had a year long relationship 6 and half years ago and he is the father of my daughter.
We never lived together and I never worked for his business. He says that hmrc will want to see all my financial records and bank statements because he pays me a small amount of child maintence. We never had any joint financial arangements so I don't see what his tax problems have to do with me. I would have thought that I just would have to confirm the amount of child maintence.

Can anyone advise me

Well until HMRC write to YOU and request this info. don't do anything.
It's very unlikely that they will bother to open an enquiry into your affairs after this length of time.
With a pinch of salt take what I say, but don't exceed your RDA

i think you can take what he says with a pinch of salt-cant believe HMRC would be interested in looking at your affairs especially as you had no interest in his business affairs and the relationship ended a number of years ago. Sit tight until HMRC get in touch and then seek further advice via this site. regards. manoj.anand@wlhtax.co.uk

Previous assurances to wait and see is also my recommendation given that your relationship was so long ago and therefore it is unlikely that they would resort to asking for your bank and other financial accounts. Should your ex-partner ask for sight of your bank accounts tell him "No".

In circumstances such as this your ex-partners tax adviser should be able to resist such requests - as unreasonable unless immediate tie in to your ex-partners financial position and needs - for your banking accounts and if he is not then he should be seeking specialist investigation advice himself

As a very last resort there are safegaurds for your own confidentiality if the requests turn out to be reasonable and I would recommend that you come back to this forum or contact us variously direct
