Holiday entitlement

Holiday entitlement

Employee has 28 days annual leave plus bank holidays. If they leave at end of March (leave year = calendar year), is accrued holiday entitlement worked out on 3/12 x 28 days or 3/12 x 36 days (ie 28 + 8)?

The contract of employment will determine how the entitlement is worked out.

Almost certainly 3/12 times 28 unless the contract says something contrary. The employee gets the benefit of bank hols off as and when they fall i.e. there is no entitlement built up.
