Inland Revenue say i owe them money

Postby aboima@yahoo.com on Sat Aug 27, 2005 3:26 am

I filled in a tax return form and Inland Revenue finally got back to me saying i owe them £1600.00 as i was paying too little tax.

I don't know how i could be in this situation in the first place as i was not aware it was my responsibilty to ensure i paid the right tax given i am NOT self employed.

All i recall is that i changed jobs between two companies owned by the same owner and in the same building. Please note i did not get an increase in salary.

Probably my then employer considered it an internal matter as i did not get a p45 issued to me which as i understand would have triggered a possible change in tax code and a P91 form. is that how it works?

When i challenged inland revenue about why my tax had increased when my salary hadnt they said tax had gone up.I understand this.

But i feel either inland revenue or my past employer are responsible for this situation. Inland revenue because i had informed them years ago of a change in address and i found out that they were sending paperwork to my old address. they have admitted in writing writing to the wrong address was their fault. or my employer who never issued me a p45 when i changed jobs between two internal companies cause perhaps they considered it an internal matter?

I know i probably have to pay the bill at the end of the day however, i want to pay it on my own terms and that is via my tax code at 100.00 a month and without Inland Revenue charging Interest. Please help. what are my rights?

Do you agree that you have paid too little tax? If not, you will need to challenge HMRC.

If so, then you will need a good reason why you should benefit from this.

It is possible for HMRC to waive the tax if you can fit within the Official Error guidelines.

Hi King_Maker i wouldnt know if i have paid more or little tax.

I was advised by IR that my tax code of 879T was wrong. i asked how could that be. i told them that even though i had changed jobs to work for another outlet of the same company my salary had not been increased.

They told me that Income tax had gone up and my tax code did not reflect the changes.

I would blame them in some way for not communicating any change as they were writing to my wrong address.

Apparently i am to blame if i do not commnucate the right tax code to my work place but they failed to get the correct tax code to me. And as for my work place they did not issue me with a p45 when i changed jobs between 2 companies with the same address and owner.I understand this would have triggered a p91 form and so i may not be in this predicament.

IR have already admitted in writing that they had written to the wrong address. And the 100.00 they had charged me for not returning my tax form was waived.

Please who falls within the official error guidelines? Do i have a case in any shape or form.

Andrew
