Is Stamp duty due if my mother in law gives me a 85% share of her house

Postby old Jock on Sat Oct 09, 2004 6:39 am

My wife and I are thinking of moving in with my mother in law, she intends to retain one sixth of the house and give my wife/me the other 5/6 . We would also give some money to my wifes brothers. Would I have tp pay stamp duty? Any help or guidance would be appreciated.

Thanks

Jock

Yes you would unless it is a pure gift with no consideration.

I know a solicitor who could do this work with little fuss.
