Land Transfer

Land Transfer

Postby Bingley99 on Sun Sep 18, 2011 8:20 pm

I recently purchased a small parcel of land on behalf of my brother in law (with his money). The land is registered in my name because he did not want his neighbours to know he was buying it. The land is adjacent to his house which he is now selling and he needs to now have the land transferred to his name so that he can offer it to a prospective house purchaser.

My question is, are there any tax implications for me in the transfer and what is the best way to do this? Is it possible to 'gift' the land to him?

Thanks for looking

No need to transfer the legal title you currently hold to brother. You can transfer directly to the ultimate purchaser.

You hold the title on trust for brother; he already owns the beneficial title (as such you cannot gift it to him as he owns it already).
