Late filing has caused determination to stay..

Hi there..

Just curious as to a next step more than anything..

I was late filing SA forms for 2004-2007 which i was at the time unaware of for various reasons, mainly wrong address for forms and didnt have online facility at the time. To cut a long story short i have filed ALL my SA and have made sure everything is up to date including the current year and have ZERO tax to pay on all of these years. However i received a letter today stating that even though i have no tax to pay on the years from 2004-07 because the time limits for

    2004 - 31 January 2010
    2005 - 1 April 2010
    2006 - 5 April 2010
    2007 - 5 April 2011

Have all passed they are stating that even though they have my forms and information ( included P60's and everything i could ) they do not intend to take any further action regarding the inforamtion contained in these forms and the determination of tax still remains in force. However they will remove the fixed penalties for those years.

Im not sure what to do now... ive heard about the Equitable liability but not sure if that covers those years even though it is now not current legislation ( i believe ).. but feel like ive tried so hard to make sure EVERYTHING is up to date and have still been kicked in the teeth. A bill of £600 tax plus interest for each of these years is hard to swallow on my income and surely there must be something i can do. Partly feel like the officer in charge of my case has pushed this to one side as easily as possible due to the current time of year when they of course receive lots of SA's in to the system.

Any advice?

Also in stating they will remove the penalties, thats surely like admitting that i had ZERO tax to pay... as my P60's indicated...

The time limits sometimes work both ways. They protect you from HMRC going back too far without good (or any) reason, but they can also protect HMRC.

The Late Filing Penalty for years prior to 2010-11 was the LOWER of £100 or the tax due.

If you are correct in that no tax was due for the relevant years, what does the £600 "tax" refer to?

A determination which cannot be displaced by a tax return because it is too late?
