No longer a uk resident - curing the confusion?

Okay... on march the 27th 2011, i left the UK and applied for temporary residency in Poland, and i am still living there now... Previouslto moving to poland i had worked full time up until january 2011 when i dropped to part time and also had fully paid bouts of sickness covered by a doctors note... (never applied, nor recived any benefits - for informational sake)

A friend of mine visited and informed me within a discussion that i may be entitled to a refund on tax and NI contributions paid for that year.

I'm able to find information backing this up, but unable to find the actual documents that i would need to file and post to the UK... seem to be having one of those days :)

Secondly - I have no payslips, nor do i have my P45 or anything along those lines. am i right in assuming that i could still file without these said documents? as i assume they will have a full record of all tax and NI contributions? and thus be able to follow up my claim based on their numbers?

Okay and thirdly, My polish partener worked in the uk for just under 3 months in 2011, never paid tax, but was deducted for NI contributions... I assume she would have to file a different form? or the same :S and if so could you help out with a referance to the required form.

i can find information on companies who will file it on your behalf, but i would like to understand how i can do it independantly.

Hi j4k3hh

Generally where an employee leaves the UK part way through a UK tax year (6 April to 5 April) and qualifies as not resident and not ordinarily resident he/she will be entitled to a tax refund as they will not have received their full UK personal allowance through the PAYE system. Given the proximity of your departure date to the end of the UK tax year it is possible you will not be entitled to a refund as you will have been allocated your full UK allowance through the PAYE system.

If you have been working full-time in Poland since your UK departure, it is likely that you will be regarded as not resident and not ordinarily resident for UK tax purposes from 28 March 2011 provided your emploment continues beyond 5 April 2012 and your return visits are within permitted tolerances. If you are not working in Poland, attaining a NR/NOR status will be less straightforward.

You should consider submiting a form P85 to HM Revenue and Customs to advise them of your departure from the UK (ideally with your form P45) although the P85 filing is not a mandatory requirement. If you cannot find your form P45, I suggest you file your P85 without it.

I am not aware how you would qualify for a UK NIC refund.
