Can HMRC's position on ones domicile be challenged?


Yes.

Does this happen in a civil court?


Yes.

Also does case law apply to these proceedings?


Yes.

Do HMRC lose any of these cases regarding domiciles and do they have to pay legal costs?


Yes, they do lose cases. You normally bear your own costs.

You would hope HMRC would look at case law before pursuing a domicile issue from the wrong end...or is it just a matter that they hope the beneficiary can't be bothered to contest a decision?
