non resident pilot help neded

Hi

Hope you can help

I am a non resident pilot, employed by BA residing in Spain for 3 years now.

I earn £100k per year and have been only in the uk circa 10 days per year so have filed previous years tax returns with a foreign earnings deduction of circa 95% and had no tax liability

for 2010/2011 I have been in the UK for 169 days , I have not paid any tax on my earnings? do I put through a foreign earnings deduction of circa 50% and pay tax on the difference or something else?

If you are UK domiciled but non-residnet and non-ordinarily resident then you are liable to UK income tax on earnings attributable to UK duties (broadly on a time allocation basis).

However, HMRC may decide to argue that you are UK resident (and ord-residnet) for 2010/11 depending upon the facts.

I take it the employer is a UK resident company, not a Spanish company.

Do you fly to/from the UK? Do you own property in the UK? Be careful; HMRC won a residence case concerning a BA pilot, Lyle Grace. Further information here.
