non resident returning to UK

Hello

Having been resident abroad (Hong Kong) for many years, I may be returning to the UK this year.

Is there an official procedure to inform HMRC that I have returned ?

I understand that I will be treated as a UK resident for tax purposes from the day I return. Is that correct ? Do I need to worry about any income earned while in Hong Kong before I return ? Is there any advantage to returning on or before a certain date in the tax year ?

I will continue to be paid a monthly salary, to my bank account in HK by my employer in Hong Kong, as I will still be a director. But I shall not perform any duties relating to that while in the UK. I shall return to Hong Kong for short periods to perform those duties. My understanding is that I will have to declare this income to HMRC and will be taxed on it even though I shall also be taxed on it in Hong Kong.

On the assumption that you will acquire UK residency and you are UK domiciled you will be subject to UK income tax on the salary.

Any HK tax will be offsettable against any UK tax charge.

On return it is normal but by no means necessary to complete Form P86.

If I return mid-way through a tax year, as I probably will (around October this year), will I be subject to UK tax on the income I earn in Hong Kong from the start of the tax year, or only from the date I return ?

By concession, not law, HMRC split tax years in the tax year of departure and arrival.

Thus, income/gains arising pre the date of your return should not be subject to UK tax.
