Obligation of completing Self Assessment?

Am I obliged to complete a self-assessment for HMRC for the following years?

1) 2010-2011, gross annual income of £102K, taxed via PAYE code of 647L

2) 2011-2012, gross annual income of £106K, taxed via PAYE code of 747L

I moved to the UK in May 2010 and am not very familiar with taxes here. I now suspect that both PAYE codes above may underpay my taxes as my personal allowance has to be reduced by being above the 100K threshold. However, I have not received any letters from HMRC for 2010-11 asking me to do a self-assessment. Even if I don't receive such a letter, am I automatically under obligation to do a self-assessment if my salary is above 100K? And am I breaching any laws, if I don't complete a self-asessment for the above years?

HMRC suggest you complete a tax return.

This may not actually be a legal requirement, but as you are aware of a higher rate liability, it's in your best interest to submit a return.
With a pinch of salt take what I say, but don't exceed your RDA

Notwithstanding no SA Return being issued, you are under a duty to notify HMRC of chargeability to tax.

The deadline for 2010-11 was 5 October 2011.

I suggest you do something asap. It might be prudent to seek professional advice, as your case might not be straight forward.

Thanks, both, for your replies.. I have contacted HMRC this morning and am now arranging new tax codes as well as return deadline extensions for 2010.

Hello Downtown Boy,

If your annual income is £100,000 or more you do need to complete a tax return and HMRC need to be notified.

The deadline to register for Self Assessment with HMRC is 05 October following the tax year that a return is required which obviously has now passed.

However, the deadline to file your tax return for 2010/2011 is 31 January 2012 so you still have some time. Your case is not straightforward though as you moved to the UK during this tax year so residency will need to be taken into account which is quite a complex area if you are not familiar with UK taxation regulations.
