I sold my main residence at the start of November 2015 before the budget which brought in the SDLT 3% surcharge for buying additional homes, with the hope of moving to a better area. In the meantime I have been living in the spare room of my brother's house which I do own half of, and although I have not declared this to be my main residence all correspondence such as banking and tax letters do get posted to this address.
Will my circumstances mean that should I find the house I want to buy, I will be subject to paying the 3% SDLT surcharge in addition to whatever stamp duty i would ordinarily be liable for?
