you pay him what is due to him under the contract. if the contract stipulates a price + VAT then that is what you pay.
If he is not registered for VAT, then VAT is not due.

totally agree. most contracts will state vat will be charged where applicable.

If the contract stipulates a price of £100 plus VAT and the supplier is not VAT registered then as no VAT is due the contract requires the customer to pay £100 not £120.
