3% Additional SDLT Query!

Postby Randymch5856 » Wed Sep 21, 2016 5:50 pm

I am sure this has been asked a million times on here and I have read pages of policy on HMRC, but frankly the answers are at best contradictory!

My query is as follows:

My husband (married Oct 15) and I both bought our own homes before we met and since 2007 I have lived with my husband at his property.

We spent some time preparing my property for sale but it was as the market crashed and so we now rent it out and I pay tax on it through my PAYE.

We are now selling my husbands home and buying our forever home together, in which we will obviously live.

Does this mean we have to pay the additional 3%? what is defined as 'main residence'?

Any help or advice extremely welcome!

Your (main) home, where you (mainly) live
