I jointly own a property in Greece with my brother (50/50). I made a declaration of trust with my wife for her to be absolute beneficiary of this property (my share thereof) but legal title is still with me and my brother. For any rental income associated with this property I am assuming this will be declared on my wife's SA given the DoT. I am concerned this maybe challenged by HMRC given legal title, and wondered if anyone could offer any further advice. Would be happy to pay!

Any challenge by HMRC will be rebutted with the production of a valid declaration of trust.
