Council charging VAT on a mooring rental

I am renting a residential mooring space on the river Colne from Three Rivers Council who own the land.
As a Council, is it feasible that they charge me VAT on the rent? No other service of any sort is provided. Why would a Council me VAT registered, they are not a business are they?
