Re Income in a Trust

Re Income in a Trust

Postby Purcell on Thu Feb 24, 2011 8:24 pm

I am a beneficiary of a Discretionary Jersey Trust, the trust has rental income from UK properties. I am Non Dom. The question is, is that income treated as unremitted gains for me or do I only need to have the declare/pay tax on distributions from the Trust.
Thank you

The trust will pay tax on the income at the discretionary trust rate (50%).
If it is subsequently distributed it is treated as untaxed income of the beneficiary, there is no automatic tax credit, however some relief may be available to the beneficiary under ESC B18
