Spilt year but never actually became non resident.

Hi,

Hopefully someone can give me some advice.

I left the UK to work abroad at the end of December 2008, however due to personnel circumstances I never met the average 90 days requirement on my first review in April 2010.

Therefore I'm resident and must pay the tax due. For tax year 09/10 this is no problem as I'm currently completing my tax return. However my accountant claimed spilt year treatment for the end of 08/09, how do I correct this? and pay the tax due.

I now intend to become non resident as of 6th April 2010.

It sounds like you need to do an amended 2009 tax return to start with, but without more information it's difficult to advise.

You may need professional assistance (sorry about that).

Thanks, have now got the answer from my tax advisor:

As I have not returned to the UK to live (Still work and live abroad) its not a problem. I will have to pay tax for 09/10 as I did not meet the 91 day rule. But will hopefully be out for the 10/11 tax year.

As a matter of interest I'm a little unclear as to what you mean by "it's not a problem" ?

As I have been advised I pay the tax due for 09/10.
