Stamp duty confusion

Hi all. Myself and my husband are looking to buy a new property and wondering if we have to pay the higher rate stamp duty. We separated a fee years ago whereby my husband bought me out and I bought a new property. Since then we got back together and my husband moved into my new property and is currently letting out the old property. Now we are purchasing a new property jointly by sellig the property i bought on my own and wondering if we have to pay the higher rate? We are replacing our residental property and as a married couple are seen as one unit (according to information I can find on government websites) even though my husband isnt on the mortgage for the house we are selling. so I'm unclear on why we have to pay the higher rate? Could you please help.

The 3% SDLT charge should not apply.
