Hi There

We have had our offer accepted on a property that has a 2 bedroom annexe within the grounds, we have advised our solictitor of this and they advised we need to seek advice from an expert! I am just wondering how we calculate if we will be liable for the extra 3% as all the information online appears very vague by saying things like 'you may not be liable.....'

Any advice would be much appreciated ...

Assuming that the new purchase is a replacement for your current residence then normally the 3% wouldn't apply. The following conditions would need to be satisfied:

1. the [granny annex} dwelling must be situated within the grounds of or within the same building as the main one; and

2. the amount of the total chargeable consideration for the transaction which is attributable on a ‘just and reasonable’ basis to the main dwelling must be at least two-thirds of the chargeable consideration attributable to it and any other dwelling situated as in the bullet point above and forming part of that transaction.
