Stamp duty on gifts to non-residents

I am a non-UK resident/domicile and wish to gift my London flat to my non-UK resident/domicile brother. I am pretty sure that the transaction will not be liable to capital gains tax.

My question is whether we can claim gift relief and avoid stamp duty? Or claim any other relief to avoid stamp duty?

In which country do you live. CGT may apply in the country based of the disposal of a whold wide assett. Regards Peter

No UK SDLT is payable on gifts of property.

However, if the property is mortgaged and your brother takes over the debt, SDLT may be payable depending upon the amount involved.
