Hello I have been renting a property in Dubai as a residence for 2 years

We are returning to the uk in sept

We are going to purchase our family home

I already have 1 buy to let which had been rented out for 2 years. This is not my residential property

Will I have to pay the higher rate of stamp duty on my new property ??

Have you ever owned a house in the UK that was your residence? If so, did you dispose of it, and where did live thereafter?

Yes I did - i lived in it until 2015 when I moved it into a buy to let property. This was my residence until 2015. Then my dubai rented house was my residence

As you have disposed of a residence, you shouldn't be liable to the extra 3%,

Jaseede, I am not entirely clear that you have disposed of (eg sold) the property you used to live in. Is it just a coincidence of dates that you have been renting out a property for a year?

I have not sold my old residence I have rented it out. I have been living in dubai for 2 years renting a property in dubai. This has been my residence

So as you have not sold the property you used to live in as your only or main residence (nor disposed of a major interest in it) the exception from the surcharge for the replacement of an only or main residence does not apply to you.
