Thread 16423 revisited - any further words of wisdom?

Postby M&M on Sun Mar 18, 2007 8:43 am

Hi, All.
I was grateful for comments received last weekend (primarily from Peter D, & Simon Sweetman)on my question id=16423:
"Bare Trust? - Mortgage & Deeds originally in Kids' name for their Mum's home while Mum Paid"

I did post an update, but the thread is perhaps too far back to draw attention. Hence, this.

To fast-forward to the last paragraph of 16423 written 10/03/07:
'Peter voiced my thoughts, that we'd need a "well versed professional to test and exucute the arrangement".
My worry is that the solicitor handling tax matters at our local conveyancing firm would not be that person - since he does not believe in this course of action in the first place.'

Any takers/recommendations?.. be it from Peter, Simon, or others with experience in this area?

(I'm anxious not to be swept into alternative proceedings at our existing conveyancers, against my gut feeling that the "having held in trust" route is is what we should be establishing instead.)

Advise GREATLY appreciated!
We need to act in a couple of days (gulp!)

The solicitor should refer this to a trust specialists who can then, with you permission, place an action on the solicitor to draw up a trust to resolve your situation. Where in Scotland is your Mum I have an use a stream lawyers in Edinburgh for my clients and they have the very man. There is also a Glasgow office. I believe you have a very strong case but do not take any action, like paying off the mortgage and changing owners name until you have taken advice. Regards Peter
