Your entitlement to a personal allowance arises as a British subject under UK domestic law. As a consequence a claim under the provisions of the UK/Thailand DTA is irrelevant and not needed.

I am still having problems with form SA109, oh dear oh dear, i'm lost.
( Just a quick bit of back ground )
left uk never to return 2001, I have permanent home in Thailand. i should be none Dom.
never contacted the tax office about this, (born in uk, uk parents). i assume I can call myself non Dom from 2001 onwards ?
In 2016-2017 i brought some of my life's saving in to the uk from Jersey to buy property to rent out
140.000. this money was earned outside the uk, and before 2014, not much Tax paid world wide on the money, if any.

Question 12, I have put zero ties to to the uk as the home i brought was, and is for rental only, not for my use as a home, I also paid the extra 3% on Stamp duty.

Now questions 23,24, I have ticked and 25 i have put the date of last tax year, when I left the uk.
5-4-2001, I assume that is all correct ?

Now questions 28-39, can i just leave them all blank, as all money brought in in 2016-2017
was savings from salary from the last 20 years, or do i need to enter this figure of 140,000 in box
34 or box 37 ? i dont believe i'm making a clam for anything on this form.

Will i get taxed on this money i have brought into the uk ?

Any help would be much appreciated.

Hi All still here with SA109 uncertainty.

Question 34 is very confusing
If I have brought funds into the UK, all earned outside the UK in
previous tax years, not the current, 2016-2017 tax year
And I was non resident for all the years, for when the funds were earned. ( salary untaxed )
do I need to report this money on SA109, as I'm not clamming and remittance basis charge. ?
The notes for SA109 State
Boxes 34 and 35 Amounts of nominated
income/capital gains
You must fill in boxes 34 and 35 if you’ve put ‘X’
(only) in boxes 28, 30, 31 or 32.


I have no tick in any of these boxes, it does seem a bit strange.
Do I report the funds on some other form ? or is it of no interest to the
tax man as I was a non resident, UK citizen. ( unlikely I think )

Any help would be great
