HMRC have taken down from their website their November 2016 pdf guidance on the higher rates of SDLT (the 3% stamp duty land tax surcharge). That old version explains the replacement exception better and has more examples than the text now in the Manual indexed here: https://www.gov.uk/hmrc-internal-manuals/stamp-duty-land-tax-manual/sdltm09730 The Manual has the advantage of having been updated for the changes made by the Autumn Budget with effect from 22 November 2017.

HMRC expect shortly to replace the brief gov.uk guidance put up in March 2017: https://www.gov.uk/guidance/stamp-duty-land-tax-buying-an-additional-residential-property

There is a meeting tomorrow to discuss the latest draft.
