How do taxes work for American on dependant visa living in the UK part time?

Postby taxymctaxface » Mon Jul 14, 2025 11:18 pm

Hi all,

My soon-to-be husband and I are planning to move to England from the USA in October and are trying to figure out how taxes will work for him.

I am starting a 3 year full time DPhil by research program and will be bringing him as a dependant on my student visa. He currently has a job in the US that requires him to work in person for ~6 months of the year (May-October) and allows him to work remotely the other ~6 months of the year (November-April). If he is located in the UK for ~half the year while working remotely for an American company, will he pay taxes to both governments? If so, will he only pay taxes on the income earned during the portion of the year he is living in the UK? After how many months does the requirement to pay UK taxes kick in?

We’d appreciate any advice!

A single day can trigger tax if working in the UK, generally if non UK tax resident you would be taxed on income arising from UK workdays, albeit under treaty it may be exempt if certain conditions are met. You'd need to read it up.

From a legal perspective, does the visa definitely allow him to work in the UK?

Your spouse's employer will doubtless take legal advice on their obligations under local law, such as statutory sick pay, auto enrolled pensions, minimum wage, 28 days minimum paid holidays etc. Your spouse will be subject to UK tax on worldwide employment income but can claim overseas workdays relief. You may both benefit from taking dually US and UK qualified advice before moving to the UK.

If someone works in the UK for just one day and gets paid for UK duties, they have to pay taxes. If the person meets certain requirements, tax treaties may not apply. It is important to make sure that the visa allows the person to work in the UK....
