Forms IHT205-2011 and 217 - how to include RNRB?

Postby warric48 » Fri Feb 23, 2018 3:48 pm

I've been looking at the IHT implications of my father-in-law's estate - he died on 19 Feb 2018. His wife died in 2004 and there should be a transfer of the NRB from then. We will also be able to use the residential NRB allowance, but I can't see at the moment how to include this in the various boxes on the 205 and 217 forms - there is no mention of RNRB on these forms.
I'd be very grateful for any assistance.

You may find that if you need to use the transferable residential nil rate band, (rather than just the NRB and regular transferable NRB) you do not qualify for the IHT205 and have to use the longer IHT400.

IHT205 can only be used for "excepted estates" and these are described in a 2004 statutory instrument last updated in 2011. The definition allows double the NRB when the first spouse left everything to the survivor but makes no mention of the RNRB.

HMRC have not yet updated the forms and guidance properly for the RNRB and TRNRB. The IHT400 doesn't cover it very well either.

Thanks very much for your helpful information. I think I will now talk to HMRC about it - if they can shed some light on it, I will post again.

Just to close this out - confirmed from HMRC that we need to use the IHT400 route. There are 2 new schedules (IHT435 and 436) which deal with RNRB. Thanks AGoodman for your help.
