My husband inherited half a house with his sister and his father is living in the house without paying rent. If my husband and I buy a house for the first time together to live in as a principal private residence with out two daughters will we have to pay the higher rate of stamp duty? If yes, would it be different if I were to buy the house in my name only?

Assuming your husband's inheritance did not exceed 50% of the property then it can be ignored for 3% SDLT purposes for a period of 3 years from the date of the inheritance.

Hence, a purchase by you both will not incur the 3% charge.
