I am dealing with a number of settlements following the failure of other (not BMST) schemes (not sold/promoted by me, I'm pleased to say) and the general position of HMRC on these seems to be that they require a full settlement of tax and interest. We have had a similar letter last week from HMRC questioning effective rate of tax on a case. Still deciding on the approach to take to HMRC, but this is a case where sideways loss relief claimed and white space disclosure (two pages) made concerning the loss making trade (not a scheme arrangement)....
