There is to be a standard 12 week consultation period once the Consultation Paper is published. This is still expected towards the end of this month, but the draft has to go before Ministers and special advisers first.

The complications involving usufructs should not matter if you can get around the 3% surcharge another way. Have you lived in the property concerned throughout the last 3 years? It sounds as if the same person controls both companies. That makes them connected and so I would expect SDLT to be due on the market value of the property because of FA2003/s53.

I have heard that the Treasury and HMRC are aiming to publish the Consultation Paper around the end of the month.

We are expecting the Consultation Paper on the extra 1% stamp duty land tax for non-resident buyers to come out some time this month.

At the time in 2006 SDLT worked on a slab rate system, not a slice rate like now. So the whole of the price would have been charged at one rate then. HMRC publish the rates for different periods. I expect it would have been 1% then if the figure was £135,000, so SDLT of £1,350.

HM Treasury have replied to a letter about their consultation and have referred to the "new SDLT surcharge of 1% on non-residents buying residential property in England and Northern Ireland to help to control house price growth and so help ensure those resident in the UK can get on the housing ladde...

A property adjustment order could indeed be an order made with the consent of the parties. If there is the right kind of property adjustment order then that property should not count against you for the purposes of the higher rates of SDLT.
