Stamp Duty on Divorce

Postby StampDog1234 » Thu Jan 30, 2025 5:13 pm

Hi

I bought a house when separated (January) and paid higher Stamp Duty on this house "new house" (March) as it was effectively a second home.
Ex and kids remained in what was main home.

In the Court Order signed a few months later (August) the "new home" was agreed to transfer to Ex and she moved into that and I moved back into Main Home.

I believe I can reclaim the stamp on the "new house" where I paid the extra Stamp.

Any tips / thoughts?

No, I'm afraid I don't think you can reclaim anything.

The relief only seems to be available if you dispose of the original property (what you have called the Main Home).

it's para 3(7) here:
