Hi,

Quick couple of questions, would be really grateful for advice on tax.

Scenario A
If a daughter transfers a house to her father as a gift (no reservation of benefit) what tax would be owed? The house is valued at the same price as when she bought it so no CGT. But what about SDLT stamp duty - is this payable on a gift?

Scenario B
Same question if a wife transfers a house (different house - not the same house as scenario A) to her husband (no reservation of benefit) as a gift. Is there CGT or SDLT stamp duty to be payed on this transfer?

1. If value hasn’t increased, there is no gain, therefore no CGT.

2. No CGT between husband and wife.

SDLT is payable on actual consideration paid.
