Stamp Duty Surcharge Limit

Postby PPitstop » Thu Jun 26, 2025 10:09 am

Hello!

Hopefully a quick question. I just moved home, without selling my old one. I want to hold on to my old house for sentimental reasons and so my plan is to rent it out.

However, people who know me well tell me I am underestimating the issues of being a landlord.

So my question is, if I try renting out my old house for 1-2 years but change my mind and sell within 3 years of when I lived there, can I still claim a refund of the stamp duty surcharge for replacing my main residence? Or do I lose that option once I rent out my old house?

Thank you!

Yes, provided you sell within 3 years, it makes no difference what you do with it in the meantime.
