My partner has recently divorced from her husband. As part of the deal we kept the house which had been in joint names; we paid him £125,000 cash consideration and took over the remainder of the motgage of £159k whcih had previously been in joint names.

We have now transferred both the house and motgage into our joint names.
2 questions
1. What stamp duty is payable ie is it both on the consideration paid and mortgage.
2. At what rate

Regards

There is an exemption from stamp duty for transfers on court orders or agreements "made in connection with the dissolution of their marriage"
