Hi all

James own a house in his solo name which is let out currently and will be let for a very long time (It was James main residency prior renovating and letting out). It has BTL mortgage on it. Currently James and his wife and children are renting but sooner his wife will purchase a flat and live as their main residency while James house will be rented out. James is married legally and live with his wife and children together. Katie will be buying a flat put into her name only, while James retain solo ownership of his house, so each of them will have one property in their names.

Does Katie has to pay additional 3% sdlt charge when purchasing her flat, even thought it's her first property ?

Also forgot to state, they are replacing their residency within 15 months after they move from the house in mid september 2015.

Don't understand second post.

As it seems there is no sole or main residence replacement the 3% charge applies.

Sorry I confused it this with second post. Here you go again.

Mid September 2015, James and his wife with kids moved out of the housed they used to live as their private residency, house is in James solo name only and is rented since summer 2016, currently they are renting and his wife is buying now a flat in her solo name which they will live as their private residency while James house is rented. They are replacing their PR within 14 months. Would 3% sdlt adittional charge applies to his wife when buying a flat ?
