Stamp duty holiday

We have a main home (a detached house) and in addition a small buy to let flat purchased many year ago and in which we have never lived .

We would like to take advantage of the stamp duty holiday to sell our main home (a house) and replace it with a new main home (a large flat)

The purchase price of the new main home (flat) will be less than £500,000 so will escape stamp duty, but will the fact that we already own a “buy to let” property mean that we will be liable for the surcharge of 3% on the purchase of our new main home (flat)

Our present main home (house) will be sold just prior to the purchase of the new main home (flat)

No, as long as you’re replacing your main home, you won’t pay any SDLT for a purchase under £500k completed before 31 March 2021.

It is key that your old home is sold. That is what you propose so the “replacement exception” should apply.
