SDLT Surcharge if Purchasing Small Share in Second Property

Postby Coops031 » Tue Nov 10, 2020 6:38 pm

My partner and I are planning to buy a house together. She already owns a property that she will retain as a BTL, and I do not currently own a property. If we buy as tenants in common to reflect that I will be providing substantially more capital (c.85%) of the purchase price, will she only be liable to pay the additional 3% on her 15% share? We would draft a declaration of trust to reflect the respective shares on completion.

Grateful for any guidance.

The 3% extra, if due, will apply to the whole price.
