3% Stamp Duty reclaim (additional property sold within 3 years)

Hi,

I am after some advice on the additional property stamp duty please.

We have lived in our main residence since 2017 with the intention of demolishing the house and rebuilding on the site.

In March 2019 we purchased an 'additional property' to live in whilst 'main residence' stood empty through planning issues and was then demolished and rebuilt, we have since moved back onto the main residence site and sold the additional property property within 3 years in 2021.

We paid the 3% sdlt on the additional property in March 2019.

Reclaims are available if the old property is sold within 3 years, but does anyone know if its possible to reclaim if the new property is sold within 3 years? I understand normally a reclaim wouldn't be available as it could be a 2nd home, Flip, BTL investment for financial gain etc. However ours was neither of those, it was a replacement home whilst the other stood empty, which i suppose could be proved via council tax payments. Has anyone heard of similar please?

There are 2 criteria:
1. Your new house needs to be your residence ( temporary occultation does not count)
2. You need to sell the old residence.

Thanks for the reply, we don't meet those criteria.

Just clutching at straws really, the old residence wasn't sold but it was demolished and taken off the valuation register. Could this be considered tantamount to a sale?!
