Can HMRC charge us interest here? (Historical officer assessment)

Postby Ishtra31 » Thu Jun 25, 2015 2:41 pm

One of the companies in our group is being liquidated and we have filled in the applicable forms to deregister it from VAT a couple of months ago.

I don't know whether this triggered the following, or whether it is altogether unrelated, but a debit balance then appeared in May in our HMRC VAT account relating to an interest adjustment. Having queried this with HMRC, they said that the adjustment related to undercharged interest on an officers assessment that took place in August 2006. They are at a loss to understand why it has appeared now, and is something that they have not seen before, but it is a balance we need to settle.

My question is, are HMRC entitled to ask for this money now, 9 years after the assessment took place, having never sought it previously?

Thanks for any assistance you may be able to provide here.

If the company is being liquidated then the interest would just become and additional unsecured creditor and therefore no need to pay it
