Draw down pension emergency tax

Postby Med2025 » Thu Oct 24, 2024 7:30 am

Hi all,
I am planning to move to Colombia at the start of the financial year next year 2025 to retire early. I have already taken out my 25% tax free lump sum from my company pension and i want to draw down £1000 a month of the remaining pot. This will be my only income. I am aware that i shouldn't be taxed on this amount as it falls under the personnel allowance tax bracket but i have heard that i will be emergency taxed on this amount which i can claim back.
My question is: Will the emergency tax come out of the first months £1k or monthly? Would it be easier for me to draw out £12k in one lump and deal with claiming back the emergency tax that way? I would rather keep my monthly draw downs as financial evidence for applying for my retirement visa.
Any help and advice would be much appreciated! :D

Would you be drawing down whilst in Columbia and have you checked the rules there? Brief read of the tax treaty leads me to believe it may only be taxable there once you are tax resident.

Emergency tax will operate on each draw down. If it's on an M1 basis it wouldn't be a good idea to do it as one lump sum for cash flow purposes.

Yes i will be drawing down starting April next year when i get to Colombia. I wont become a tax resident of Colombia until 2027 as i will be travelling around south America but intend to spend 6 months out of 12 for the first 2 years in Colombia under a tourist visa. I have been told that HMRC will emergency tax my pension at source with my pension company then i will have to claim it back which will be difficult as i will not be in the UK. I believe it will be a cheque that has to be sent to a UK address but i will get a relative to sort that. I am hoping that when HMRC see that i am getting a regular amount each month that they can sort out my proper tax code?

I'm not quite sure what you think the problem is here?

The emergency tax code is 1257L, so if you are taking £1,000 of taxable income on a monthly basis why do you think any tax would be deducted?

Hi,
As a reply to the previous post asking "...if your taking £1000 a month taxable income why do you think you will be deducted tax?"
I was told i would be emergency taxed on my £1000 a month drawdown on my pension to start with which i would have to claim back from HMRC. I have asked HMRC about this by email but got no reply so it looks like i will have to ask them again. If i dont get emergency taxed or taxed at all on that amount then great. I just need to know in advance if i have to go about trying to claim back emergency tax when im in south America as it will be hassle for me. I am not familiar with how the taxation will work with my £1000 a month drawdown. Thanks for the replies.

I still don't understand what the problem is here?

I suspect you simply don't understand what emergency tax is and are making some incorrect assumptions.

The emergency tax code is 1257L.

So if you took £1,000 in taxable income from your pension how much tax do you think this emergency tax code would mean was deducted from that £1,000 🤔

The emergency tax code is strictly 1257LM1, but a £1000 per month drawdown should still in principle generate no PAYE as the emergency code should give a monthly tax free allowance of £1048
