Invoice header does not match bank details

Morning all,

I hope you had a great Christmas. I am requiring some advice.

I'm in receipt of a adjoining party wall surveyor invoice. The header and footer refer to the company who carried our the party wall award. However the bank details are for a separate company. When challenged on this, the surveyor claimed that the company on the bank details owned the company on the invoice header. I have checked with Companies House and they cannot see any corporate relationship between the two entities.

I've asked that the invoice is re-issued with the correct bank details or a there is a note from the company who did the survey to discharge the debt. This is being refused and I am being threatened with court if I do not pay.

What is happening here, are they trying to stay below the VAT threshold? Is this legal?

Are the bank details on the invoice that you expected, or supplied separately? I'd tend to assume that if they're on the invoice then it's probably correct, particularly if you've contacted them and they've confirmed that it's their invoice.

But how about calling your bank's fraud department and asking for their help? They're probably best able to advise how you should proceed here. Ultimately, I don't think you have any right to insist that the bank account is in any particular name.
