1. Form 17 has no application where the legal interest in a property is in the name of one spouse only.

2. Why 99/1% and not 100/0%?

My only point, to go back to mullet’s first post para 2, was simply that it may not be “wise” to gift to your wife the inherited flat if your only reason for wishing to do so is to have the rental income taxed to her, a basic rate taxpayer, rather than to you, a higher rate taxpayer.
