A cohort of previously law abiding people (self-assessment taxpayers) who became felons overnight on the introduction of a new reporting system (NRCGT) .....and zero empathy from a Government controlled body (HMRC).....where have I heard a similar story recently?

NRCGT is a magnificent example of how not to introduce a tax reporting system.

Over one million views and still nobody regulating HMRC has seemingly questioned their assertion that they treat taxpayers fairly, even though the successful late filing appeal rate has fluctuated from 3% (to mind the gap) 99%.

And then the reporting ban by the FOI Office on the associated statistics...it all stinks.

I've lifted the following from a rugby forum, but I think it applies to HMRC and all the people who are supposed to check they are doing the right thing (they are clearly failing as simple tax refunds should not take 12 months to process...post is not being looked at in date order, etc etc etc.):

The phrase we are looking for is "moral hazard". If you can behave badly with a reasonable expectation that you will not be held to account and it is in your interests to behave badly, then for some people behaving badly becomes a simple moral choice. You should because you can. Which is the reversal of how the game of rugby has always told itself it wants to behave.

I've copied the above from another thread as I strongly believe so many people should have intervened in the NRCGT arena. As I speak Alan Bates and his lawyer are talking of waiting X working days before receiving a semblance of a reply and bosses not being held to account...yupp exactly!

Even-handedly does not mean “the same”.

We will agree that it was wrong for HMRC to announce a review of HICBC penalties. By doing so they have opened a can of worms and set a precedent that will bite them.

A review of NRCGT penalties would have been the obvious choice and could have been explained away as unique because of the specific circumstances.

Not far off 5 years since this post and to date still no review of NRCGT penalties/signs of HMRC being bitten. A sad indictment of the regulation of HMRC in this period. A fluctuation in successful appeals from 3% to 'mind the gap' 99% and nobody asks the question...have taxpayers been treated fairly?

And don't forget the following information denials from HMRC's FOI office (in my eyes a cover up).

I shouldn't watch breakfast TV.

Rob Rinder this morning suggesting the Post Office bods may be in serious trouble because they apparently knew the Fujitsu system was rubbish but kept their heads down and ignored the evidence.

Sir Jim must know HMRC has not treated NRCGT penalty victims fairly, but still no sign of a review. Should he be making morning tea in Strangeways too? Perhaps for the regulators who allow failing systems to continue unchecked.

The high-income child benefit charge (HICBC) continues to astound and appal regular observers, as illustrated by the first tier tribunal (FTT) case of Benjamin Erridge (TC09122).

Judge Anne Redston was able to rein back some of the madness but regretted that there were limits to what the tribunal could do.


That the FTT chose to side with the taxpayer and not HMRC illustrates that they consider HMRC abused the process to seek advantage. Something that the proposed cancellation of the phone helplines amply highlights. This case is just one more example of how broken HMRC is. It is about time it got adequate management who told its bosses (HMG) the facts of life.


Still no review of NRCGT late filing penalties where the publicity of the filing requirement from HMRC was close to non-existent....certaintly ooooodles poorer than the HICBC.

My nomination for the 2024 bullshit awards:

As HMRC chief executive Jim Harra noted at the start of the report: “Our Charter sits at the heart of what we do, setting out the standards of service and behaviours that customers should always expect from us.”

If it really is at the heart of what HMRC do, perhaps Jim should work out and explain why 97% of NRCGT late filing appeals were denied in one quarter and only 1% denied in another. Doesn't look fair to me Jim.....Taxpayers Charter...fairness and all that.

And where were the regulators when needed? 'He did say 'always' after all.

Only worth introducing if the rule is properly regulated.....need to tackle the prawn sandwich brigade. Hopefully Sir Jim will realise denying FOI requests to hide HMRC injustices is not permitted.


And all the countless injustices over the years, suffered by working people at the hands of those who were supposed to serve them.

Truth and justice concealed behind the closed ranks of the state.

And Conference, this is the meaning of Clause One. Because today I can confirm that the duty of candour will apply to public authorities and public servants, the Bill will include criminal sanctions, and that the Hillsborough law will be introduced to Parliament before the next anniversary in April.

It’s work that shows how a government of service must act in everything it does.
