CGT on selling the Marital Home

Postby fancraddock » Thu Jan 18, 2018 4:50 pm

We are going through a lengthy divorce and due to large debts having to sell the marital home.
I moved out 3 years ago and have been told by my Solicitor I could incur CGT on my part of the lump sum which we will split 50/50.
Can you advise ??

Even though you have moved out the former matrimonial home continues to qualify as your sole or main residence until the property is sold if your ex-wife/husband continued after you left to live in the property and you have not elected for any other property to be your main residence.

Any capital gain you make will be exempt.

Refer your solicitor to TCGA 1992 s.225B.
